The following guarantees and stipulations are based on what is required by Florida state law, both for the seller and the buyer, and my own recommendations. At the bottom of this page is the section of Fla. statute 828.29 that ALL breeders or "pet dealers" (who sell more than 2 litters or 20 puppies, kittens, dogs, and/or cats directly to the public) are required BY LAW to provide to their customers. The most current version of this statute, including all pertinent sub-statutes, will take precedence in any questionable situation whether verbal or written.
The puppy being purchased is guaranteed to be current on it's DA2PL+CPV and bordetella vaccinations, and to have passed a veterinarian's examination. Buyer will be provided with a copy of the health certificate. Buyer understands that the puppy will need boosters of the initial vaccinations until the DA2PL+CPV "puppy series" is completed, and then once annually thereafter. Seller recommends the following puppy vaccination schedule: DA2PL+CPV at 11, 14, and 17 weeks.
Contagious Disease
If, within 14 days of purchase, your veterinarian positively diagnoses the puppy as having a contagious disease that was definitely incubating at the time of purchase, Seller will accept immediate return of the puppy and refund the purchase price, plus the cost of testing and emergency treatment done by your veterinarian, not to exceed the purchase price of the puppy. If you choose to keep the puppy, and have it treated by your own vet, Seller will pay for the reasonable cost of treatment, not to exceed the purchase price of the puppy. If the puppy dies under a veterinarian's care (in hospital, not at home), within 14 days of purchase, as a result of a contagious disease (i.e. parvo), that was definitely incubating at the time of purchase, and timely veterinary care was obtained to no avail, Seller will refund the purchase price and applicable vet bills not to exceed the purchase price of the puppy. "Timely" means the puppy was taken to the vet for treatment at the first sign of illness or lethargy, not when the puppy was so debilitated it couldn't be saved. Seller must be notified of the illness by phone within two business days of onset, and receive (by fax, mail, or email attachment) a clear copy of the vet bill, including testing, diagnosis, treatment, and itemized cost of treatment, within three business days to qualify for reimbursement or refund.
Please note: because of their solid foundation of good health, good food, prior vaccinations, and lack of exposure, it is highly unlikely a Terragethen puppy will contract a contagious disease. It is recommended that the Buyer use common sense and not expose the new puppy to other puppies, take it to places a sick puppy has been within the past six months, or take it to public places until the puppy series of vaccinations has been completed.
Congenital Defect
If the puppy is diagnosed as having a "congenital or hereditary disorder which adversely affects the health of the animal" (from Fla. pet law 828.29(5) within one year of purchase, Buyer may return the puppy for a refund of the purchase price, return the puppy for a replacement of similar value, or retain the puppy and receive reimbursement for the reasonable cost of corrective surgery (if applicable), not to exceed the purchase price of the puppy. Buyer must notify Seller by phone or in person within two days of a serious congenital or hereditary defect being detected by a licensed veterinarian. Seller must receive a clearly written or typed notice from Buyer's veterinarian (on the veterinarian's leaderhead stationery), detailing the nature of the defect, indicating that it is indeed a congenital or hereditary defect (not possibly an injury or developmental issue), and cost of corrective surgery (if applicable), within three business days of examination to qualify for puppy return, puppy exchange, or monetary consideration. Depending on the issue, Seller may request that the Buyer's vet's statement be faxed directly to Seller's vet for his review. Seller will provide the fax number.
If anything physically unusual is detected during the examination for the health certificate, Buyer will be notified immediately. This includes developmental issues such as: underbite, luxating patella, umbilical hernia, and inguinal hernia. Buyer may cancel the sale and receive a refund of the deposit, apply the deposit to another puppy, or purchase the puppy (assuming full responsibility for any surgery that may or may not be needed to correct the issue at a future date.) Depending on the issue, Seller may choose not to sell the puppy; Buyer would receive a full refund of his/her deposit.
"An animal may not be determined unfit for sale on account of an injury sustained or illness contracted after the consumer takes possession of the animal. A veterinary finding of intestinal or external parasites is not grounds for declaring a dog or cat unfit for sale unless the animal is clinically ill because of that condition." from Fla. pet law 528.29(9)
Under Florida state law, in all cases, Seller retains the right to a second opinion by a veterinarian of her choice. The puppy must be made available for an examination by one of Seller's veterinarians, located in New Smyrna Beach, FL and Edgewater, FL. Seller must be provided with the name and phone number of Buyer's current veterinarian. Under NO circumstances may the puppy be euthanized within the first year without prior written consent from the Seller. Doing so will negate any obligation Seller may have to reimburse Buyer for the purchase price or for any veterinary costs. (Consent by e-mail would be considered "written".)
"It is the consumer's right, pursuant to section 828.29, Florida Statutes, to receive a certificate of veterinary inspection with each dog or cat purchased from a pet dealer. Such certificate shall list all vaccines and deworming medications administered to the animal and shall state that the animal has been examined by a Florida-licensed veterinarian who certifies that, to the best of the veterinarian's knowledge, the animal was found to have been healthy at the time of the veterinary examination. In the event that the consumer purchases the animal and finds it to have been unfit for purchase as provided in section 828.29(5), Florida Statutes, the consumer must notify the pet dealer within 2 business days of the veterinarian's determination that the animal was unfit. The consumer has the right to retain, return, or exchange the animal and receive reimbursement for certain related veterinary services rendered to the animal, subject to the right of the dealer to have the animal examined by another veterinarian."
