Purchase Agreement
Clan of the Poodle

You might find this odd, but nobody has to sign a contract when they purchase a puppy from me. Your word (or handshake) is good, and so is mine. Read this over (print it out, if you like), so you will know what to expect from me, and what I'll be expecting from you. There will be no surprises.

Purchasing a puppy that's ready to go

Full payment is due upon receipt of puppy. If the puppy is being shipped to you, full payment for the puppy and related shipping expenses must be received at least three (3) days prior to the estimated shipping date. The estimated shipping date is normally the weekend after the puppy goes to the vet for his checkup. The payment should be in the form of a postal or Wal-Mart money order, or a cashiers' check from a nationally known bank (examples: Bank of America, CitiBank, Wachovia.)

Putting a deposit on a puppy that isn't ready to go or hasn't been born yet

$100. deposit required to signify Buyer's commitment to purchase a non-merle puppy; $250. deposit for a merle puppy. Personal checks accepted for a deposit, as long as it is received prior to 10 days before the puppy will be eight weeks old.
Balance due upon receipt of puppy if purchased in person, or at least three (3) days prior to the estimated shipping date, if shipped.

Terms

1.   The deposit is non-refundable except in the following instances:
- Seller's veterinarian deems the puppy not suitable for sale.
- Deposit is for a specific color and sex of puppy from a specific expected litter, and no puppy of that description is produced in that litter, or another litter acceptable to Buyer.
- The puppy has a physical fault unacceptable to the Buyer (example: underbite.)

2.   If Buyer has put a deposit on a puppy not ready to go, Buyer must pay the balance for and take possession of the puppy within seven (7) days of the health certificate being issued. If Buyer does not, Seller retains the right to cancel the sale and Buyer waives all rights to a refund of his or her deposit.

3.   Seller's guarantee covers the puppy for contagious disease for two weeks from the date of purchase, and for confirmed congenital defects for one year from the date of purchase. Buyer has certain responsibilities to keep these guarantees in effect; they are detailed at www.clanofthepoodle.com/pa.html. No other warranty or guarantee is implied or given.

4.   Buyer is purchasing the puppy as a house pet and companion, not a breeding dog. Buyer will provide the puppy with a safe, comfortable home, vaccinations and veterinary care as needed, the attention a house pet would customarily receive, and proper grooming.

5.   If purchasing a female puppy, Buyer will have the puppy spayed at 6-7 months of age, prior to the first heat cycle. If purchasing a male puppy, Buyer will have the puppy neutered by the time he is 12 months old. If the buyer is purchasing the puppy with pre-approved and written (email) breeding rights, this number (5) does not apply. If you do not have pre-approved and written breeding rights, the puppy is being sold as a pet only.

6.   Buyer will not take or send the puppy to the Humane Society, SPCA, or any other "kill shelter". Buyer will not sell or give the puppy to a laboratory or any person dealing with or representing a laboratory that uses animals for testing of products and/or experimentation of any kind. Buyer will not knowingly give or sell the puppy to any individual involved with dog fighting.

7.   If the puppy is being shipped, a copy of the veterinarian's health certificate will be sent with the puppy, along with applicable registration papers. Due to my new location, there is an additional $25. veterinarian's charge for the health/travel certificate. Those picking up their puppies will be provided with written verification of puppies' vet check (including fecal exam and vaccinations) when puppy is transferred. The puppy will have had the vaccinations appropriate for its age, and and the date for the next vaccination will be suggested. Additional vaccinations, fecal exams, and de-worming should be gotten upon the advise of Buyer's veterinarian as the puppy matures. Seller recommends vaccination boosters spaced three weeks apart, until the puppy series is complete, and then once annually thereafter. The puppy will be 100% flea-free.

8.   Seller will provide Buyer with a registration application ("puppy papers") to register the puppy with the Continental Kennel Club at the time of purchase. In the rare instance that the puppy papers are not available at the time of purchase, Seller will provide Buyer with complete documentation to indicate that the litter registration application is being processed by the registering club. The registration papers will be mailed to Buyer as soon as they're received.

10.   Seller may cancel the sale prior to Buyer taking possession of the puppy in the event that Buyer listed false or misleading information on the Clan of the Poodle application. In this situation, Buyer should not expect to receive a deposit refund.
